Terms and Conditions for ResMenu

Module-specific terms for the ResEcho ResMenu module. These supplement the general Terms and Conditions.

§ 1 Subject matter of the contract

(1) The ResMenu Module is the digital menu solution on the ResEcho platform. ResMenu enables hospitality businesses to create, maintain and publish digital menus that guests can access by QR code or direct link.

(2) The current scope of ResMenu's functions is set out on the product page /modules/resmenu. The plan configuration displayed during the ordering process at the time of the order is authoritative.

(3) ResMenu is offered in three plans:

  • Free (free, forever)
  • Classic (paid)
  • Premium (paid)

The specific features and limits of the plans (in particular the number of menus, supported languages, available designs and functions) are set out in the current pricing overview at /modules/resmenu.

§ 2 Prices and billing

(1) The prices for the paid plans (Classic and Premium) are shown on the product page /modules/resmenu . All prices are net amounts and are subject to statutory VAT.

(2) As at the date on which these Terms were prepared:

Billing is always based on the price displayed during the ordering process. Price changes for existing contracts are made exclusively in accordance with § 4(5) of the General Terms and Conditions.

(3) Free plan: The Free plan is available indefinitely and free of charge. Code7Byte reserves the right to adjust the features or limits of the Free plan at any time, provided the essential character of the free offering is preserved. The provisions of the General Terms and Conditions concerning billing, payment and renewal do not apply to the Free plan; the remaining provisions (in particular liability, data protection and availability) apply accordingly.

(4) Annual billing: If annual billing is selected, the entire annual amount is due in advance. The equivalent price benefit (‘2 months free’) is already included in the annual price and does not constitute a separately itemised discount.

(5) VAT: Austrian customers pay 20% VAT. EU businesses outside Austria with a valid VAT identification number are invoiced under the reverse-charge procedure without Austrian VAT (see § 4(2) of the General Terms and Conditions).

§ 3 Changing plans

(1) Upgrade (e.g. Free → Classic, Classic → Premium):

  • Takes effect immediately.
  • The end date of the current billing period remains unchanged.
  • The price difference is calculated pro rata by Stripe and charged with the next invoice. The difference displayed during the ordering process is binding.

(2) Downgrading (switching to a lower plan) is not provided for. If the Customer wishes to switch from Premium to Classic, from Classic to Free or to another lower plan, the Customer must cancel the existing contract in accordance with § 5 of the General Terms and Conditions and enter into a new contract for the desired plan once the existing contract has expired.

(3) Switching between monthly and annual billing within the same plan is treated as a plan change within the meaning of paragraph 1 (upgrade) or paragraph 2 (downgrade). A switch from monthly to annual billing is possible at any time on a pro-rata basis; a switch from annual to monthly billing is governed by the downgrade rules.

§ 4 Customer obligations specific to ResMenu

(1) The Customer must ensure that all menu content entered into ResMenu complies with the applicable food-law requirements, in particular:

  • Allergen labelling in accordance with the LMIV / EU Regulation No 1169/2011 for the food and beverages listed by the Customer,
  • Price labelling in the form required by the applicable local price indication regulations (including final consumer prices inclusive of VAT),
  • Quantity information and unit-price information where required.

(2) Code7Byte provides input fields, structures and display formats for this information but does not review its content. The Customer alone bears legal responsibility for the accuracy, completeness and currency of the content.

(3) When using images (product images and backgrounds), the Customer must ensure that it holds the necessary rights of use and exploitation. To the extent permitted by law, Code7Byte accepts no liability for content embedded by the Customer.

(4) The Customer acknowledges that public menu pages are published in a format that can be indexed by search engines and become part of the public restaurant profile at resecho.com/res/<username> . This public visibility is an essential feature of the ResMenu service and does not constitute a defect.

§ 5 Guest reviews and marketing pop-ups (Premium features)

(1) Under the Premium plan, ResMenu provides guest-interaction features, in particular:

  • Guest reviews — a review dialogue that offers every guest the same options: a public Google review and, optionally, a direct private feedback channel to the restaurant owner — without filtering by sentiment.
  • Marketing pop-ups — scheduled notices in the guest-facing interface (e.g. promotions, review requests and social-media calls to action).

(2) The Customer must use these functions in accordance with the rules of the third-party platforms concerned (in particular Google's policies on review manipulation and the terms of social-media platforms). Code7Byte accepts no liability for whether content created by the Customer complies with those third-party rules.

(3) The Customer must not use marketing pop-ups to communicate unlawful, misleading or harassing content.

§ 6 Data export and end of contract

(1) When the contract ends, Code7Byte provides an export function in the customer account for 30 days that allows the Customer to download content stored in ResMenu (menus, allergen information and images). Once this period has expired, the data is deleted in accordance with § 5(6) of the General Terms and Conditions.

(2) The Customer acknowledges that public restaurant profiles are deactivated (/res/<username>) when the contract ends and may remain accessible for a certain period as cached search-engine results. Code7Byte has no control over the caching policies of third-party search engines.

§ 7 Application of the General Terms and Conditions

Unless these module-specific terms provide otherwise, the ResEcho General Terms and Conditions apply in full, in particular the provisions concerning:

  • Formation of the contract (§ 3)
  • Contract term, renewal and cancellation (§ 5)
  • Refunds (§ 7) — no refund of fees already paid
  • Payment failure (§ 8)
  • Availability (§ 10)
  • Data protection and processing (§ 11)
  • Liability (§ 13)
  • Final provisions (§ 19)
